Terms of Service

1. Acceptance of Terms

By accessing or using the Apatmento platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Apatmento is a marketplace platform connecting guests with hosts offering short-stay accommodations, tours, events, and related services across Kenya. We also provide referral links to third-party services including rides, food delivery, shopping, and flights.

3. User Accounts

You must create an account to book services on Apatmento. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

• You must provide accurate and complete information when creating your account
• You must be at least 18 years of age to use the Service
• You are responsible for all activity on your account
• You must notify us immediately of any unauthorized use of your account

4. Bookings and Payments

All payments on Apatmento are processed securely via M-Pesa (PayHero). When you make a booking:

• You authorize Apatmento to collect the full booking amount plus the applicable platform fee
• The host receives the booking amount in full — Apatmento retains only the fixed platform fee
• Payments are processed immediately upon booking confirmation
• Cancellation policies are set by individual hosts and disclosed before booking

5. Host Responsibilities

If you list properties or services on Apatmento as a Partner/Host, you agree to:

• Provide accurate descriptions and photos of your listing
• Honor all confirmed bookings
• Maintain the listing in the condition described
• Comply with all applicable Kenyan laws and regulations
• Not list properties you do not have the right to rent

6. Guest Responsibilities

• Treat all properties and services with respect
• Comply with house rules set by hosts
• Not use properties for illegal activities
• Report any damage or issues promptly

7. Platform Fees

Apatmento charges a fixed platform fee per confirmed booking:

• Apartments: KES 300 (bookings under KES 5,000 total) or KES 800 (KES 5,000 and above)
• Tours: KES 200 (tours under KES 5,000) or KES 500 (KES 5,000 and above)
• Events: KES 50 per ticket (under KES 1,000) or KES 150 per ticket (KES 1,000 and above)

These fees are clearly shown before you confirm any booking. We do not charge percentage-based commissions.

8. Cancellations and Refunds

Cancellation policies vary by listing and are shown on each listing page. Platform fees are non-refundable in all cases. For refund disputes, contact us at support@apatmento.com within 7 days of your booking.

9. Limitation of Liability

Apatmento is a marketplace platform and is not responsible for the actions of hosts or guests. We do not own or control any of the listed properties. Our liability is limited to the platform fee collected for any given transaction.

10. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms. We will notify users of material changes via email.
